1. All content on this website and any 'Sister Companies is the property of Memories Group and therefore protected by intellectual property laws. None of the content on the site can be copied, used or distributed without prior written consent. Content includes any text, graphics, photographs and media.
2. We endeavour to ensure that the information on this website is accurate, however, Memories Group cannot be held responsible for actions based on this information or any resulting damages.
3. The information on this site and the Terms and Conditions may be updated from time to time. Special offers may be withdrawn at any time. We will honour any agreement reached prior to withdrawal of such offers but cannot guarantee that prices will remain at the same level for any period of time. We reserve the right to add or withdraw packages as well as changing the pricing and/or feature set included in advertised packages at any time.
4. For the purposes of these Terms and Conditions, 'the Client' will be considered to be the individual or company who signs up for the service.
5. Signing up for any services provided by Memories Group implies agreement of these Terms and Conditions by the Client.
6. DVDs and any other products offered herein are created for personal use only and cannot be used to advertise, market, sell or promote any product or service except as a personal portfolio or showcase of personal work if applicable (i.e.,, a showcase DVD). Under no circumstances can Memories products be used to distribute music, movies or any media other than personal photos and video. The Client may produce or commission copies of the products for the purpose of distribution to friends and relatives only but they cannot be sold either as a whole or in part.
7. It is the Client's responsibility to ensure he/she owns the right to use any material submitted, be it still images, music, video footage or media of any kind. Memories Group operates on the assumption that the Client owns the copyright of any media submitted and will not undertake an investigation on the Clients rights to use the media. The Client will be held responsible for any breaches of copyright or intellectual property law arising from any media submitted. It is the Client's responsibility to ensure compliance with copyright and intellectual property law in both the United Kingdom and his/her own country of residence if living abroad.
8. Memories Group will not acquire the copyright or usage rights of any media submitted by the Client except by express agreement by both parties.
9. Memories Group reserves the right to refuse an order if the material submitted appears to be offensive, in poor taste or illegal in any way. This includes but is not limited to, sexually explicit and adult content. Should the material be deemed unsuitable, the Client will have the choice to either submit suitable material or get a full refund of any monies paid minus an administration fee and any setup costs and expenses incurred.
10. Once a project is finalized and paid for in full, it becomes the property of the Client, however, Memories Group will retain the copyright of the design, layout and digital effects and reserves the right to use the design and layout of the product for illustrative purposes. The Client may not use any design, layout or media from a Memories Group product for commercial purposes at any time.
11. The features included in the product will be those specified as part of the package ordered by the Client and any additional features will be subject to additional payment from the Client. Memories Group will not include any additional features without appropriate payment.
12. Memories Group will endeavour to take the utmost care with any material submitted by the Client such as photographic prints, negatives, slides, CDs, DVDs, tapes, etc. however Memories Group will not be held responsible for any loss or damage in transit or due to circumstances beyond our control. The Client is advised to send duplicates whenever possible, especially when dealing with irreplaceable items such as heritage photos.
13. It will be the Client's responsibility to cover the cost of any insurance, couriers, packaging or special delivery services he/she wishes to use other than the services included in the package ordered.
14. The Client should ensure that any materials sent by post or courier are suitably packaged for the purpose to avoid damage. Memories Group undertakes to return the items in the same condition they arrived but cannot be held responsible for loss or damage in transit.
15. Memories Group will not cover the cost of sending or submitting any materials to us from anywhere in the world. Any parcels sent must be fully paid for.
16. It is imperative that full payment be received before work can start on a project. The Client may cancel the order at any time prior to submitting the materials for the project and will obtain a full refund minus a £25 (twenty five pounds sterling) administration fee. No refunds are possible once materials have been submitted and work has commenced although in very special circumstances a partial refund could be negotiated. Please contact us to discuss.
17. It is the Client's responsibility to ensure all necessary materials are submitted to Memories Group in a timely manner. Memories Group will not be responsible for any delays arising by late submission of materials. Except by special arrangement, if materials are not submitted within two weeks of placing an order, your order will be automatically cancelled.
18. Work will only commence once all materials have been received in full. The Client will be notified by email as soon as materials have been received.
19. It is the Client's responsibility to ensure he/she chooses the most suitable package and style for his/her product. The website contains a wide range of demos to make choosing a style a painless process..
20. We offer our services worldwide, however, all prices and charges are denominated in pounds sterling.
